General Terms and Conditions for the Streetz Open Air ( St.OA )

§1 Subject of the contract
1. With the purchase of a ticket for the "Stretz Open Air" event on Friday, September 15, 2023 and Saturday, September 16, 2023, you - hereinafter referred to as "customer" - accept the following General Terms and Conditions. This includes the purchase of a day ticket accordingly.
2. Arrangements, ancillary agreements and other agreements of any kind must be in text form and confirmed by the board of Streetzrock eV to be effective
3. The "Streetz Open Air" event will take place at the designated festival site in Streetz. The festival area includes the fenced area, which may only be entered with an admission control, on the meadow of Stephan Dabrowski - hereinafter referred to as "event area". Camping area is an area outside the fence, which is specially marked on the event site. These general terms and conditions apply to the entire event site. Day parking spaces are shown separately.
4. The offer for the conclusion of the contract comes from the customer. With the purchase of a ticket in advance online or the purchase of a wristband at the box office, a contract is concluded between the customer and the organizer Streetzrock eV.
5. The minimum age for ordering or purchasing a festival ticket is 18 years.
6. The same applies to the "St.OA on Tour" event on November 19, 2022 in Groß Heide, 29451 Dannenberg

§3 Resale Prohibition
1. Streetzrock eV generally agrees to the transfer of visiting rights to a third party until entering the event site, unless:
1.1there is a house ban against the third party
1.2ticket sales are carried out by unauthorized third parties. You can find our authorized ticket offices at: www.streetzrock.de
2. In the event of a violation of the above prohibition, the organizer is entitled to withdraw the entry entitlement, or the tickets are not valid and will be blocked.

§4 Right of withdrawal for tickets
The tickets offered here are access authorization for a leisure event with a specific date for which there is no right of withdrawal according to §312g Para. 2 Number 9 BGB. By ordering online or directly purchasing a wristband for the Streetz Open Air, the contract is binding and the customer is therefore obliged to accept the tickets and to pay immediately.

§5 Payment and shipping
1. The total amount is due for payment immediately after receipt of the order confirmation.
2. Payment options are prepayment for online orders or cash payment at the box office. The box office is only open if there is no sale in the online shop and the box office is NOT open all the time. Streetzrock eV reserves the right to close the box office when there is a sell out or during the evening hours at its own discretion. The box office opens one hour before admission.
3. The tickets purchased online are either hard tickets or Print@Hometickets. Hard tickets are dispatched no later than the end of the following week after receipt of payment for the underlying order, but usually after 3 - 5 working days. The Printe@Hometickets must be printed out by the buyer himself. Both variants must be undamaged and legible to present at the entrance.
4. Streetzrock eV retains ownership of the purchased item until the invoice amount has been paid in full.
5. The customer is obliged to bring his ticket with him in a good condition that can be read by the scanning device. The scanning device must be able to recognize the tickets. If scanning is not possible due to the condition of the ticket at the entrance, the ticket for the "Stretz Open Air" event loses its validity.
6. A day ticket is valid on the respective day, from the beginning of admission to the end of the last band. The admission price shown applies without exception, also for the specified period.

§6 Arrival; Park;
The festival visitor must behave in accordance with general decency. Comradely and considerate appearance as well as the care for order and cleanliness is a natural duty of all visitors. The instructions of the security and the organizers of the "Stretz Open Air" event must be followed.
1. The journey leads over a narrow, agricultural road. Animals and residents are close to the path. Slow and considerate driving is required here (dust, noise).
2. The parking areas are marked.
3. It is a meadow; lowered vehicles are not recommended.
4. Don't forget to look out for one another on the park grounds.
5. Arrival by any means (including on foot), parking and parking of the means of transport is at your own risk.
6. Day visitors park separately in the designated day parking lot.

§7 Admission; admission control
1. Access to the "Stretz Open Air" event is only granted with a valid ticket for the event. Visitors leaving the festival site will only be granted re-entry if they are wearing a locked, non-removable, undamaged wristband. Unlocked and/or detachable wristbands lose their validity. If the ticket or the festival wristband is lost, the access authorization is no longer valid. A return or exchange of a festival wristband or ticket is generally excluded. Damaged or defective ribbons must be reported immediately. These ribbons are exchanged on a case-by-case basis.
2. Only one person will be allowed entry per valid ticket presented. The submission of an order confirmation/invoice is not sufficient. ID card checks are only carried out at the admission checkpoint if there is a suspicion or indication of misuse.
3. At the entrance to the event site, security checks (including body searches) will be carried out by security personnel. These instructions must be followed. In the event of non-compliance, the organizer reserves the right to issue an immediate eviction from the event site without refunding the entrance fee. The visitors agree to this by concluding the contract.
4. The organizer reserves the right to refuse a visitor admission to the festival site for important reasons. An important reason is in particular, but not exclusively, the carrying of prohibited objects (according to §10 of the General Terms and Conditions) and if the visitor has an obviously homophobic, sexist, racist or inhuman attitude. Entry will also be denied if the protection of minors is violated. If there is an important reason for the refusal of entry, the person loses the right to enter and thus the ticket or festival wristband becomes invalid, and the entrance fee will not be refunded.
5. Visitors under the age of 18 are only allowed entry if a parent or guardian is present. This person must be known at the entrance through documentation. Children under the age of 12 are admitted free, but everyone would be happy to receive a donation.

§8 domiciliary rights; behaviour rules
The domiciliary rights are exercised by the organizer and his orderly and security staff. The house rules apply on the festival site.
The instructions of the organizer's staff must be followed.

1. Visitors are prohibited from entering the festival site

1.1. carry prohibited objects (§10 of the General Terms and Conditions). (drinking horns and drinking cups on the belt are allowed)
1.2 . use physical violence against other visitors, staff of the organizer or other third parties.
1.3 . Throwing objects on the stage, in the area or at people.
1.4 . urinating or defecating outside of the toilet.
1.5 . to paint, spray, soil or use violence/vandalism on structures, walls, things etc.
1.6 . to engage in commercial trade, to carry out marketing campaigns or advertising measures without the prior written consent of the organizer. Advertising measures of any kind, i.e. advertising a product, a service, an ideology or religion, a trade union or party, a company or a brand, the distribution or presentation of political or religious content in any form (e.g. on books, leaflets, banners , signs, iPads etc.) as well as the attachment of decorations and other objects are strictly prohibited on the entire festival site.
1.7 . Entering areas and rooms that are not open to visitors and climbing on stages, tents, trusses or similar.
1.8. Go to the festival site with an e-scooter or similar means of transport.


2. Photographing
for private use with mobile phones is permitted. The personal rights of third parties must be protected at all times. The production of film or sound recordings of any kind and their publication online or offline without the permission of the organizer is prohibited.

3. visitor,
who violate the above rules of conduct or the rules of conduct in the General Terms and Conditions according to §1, paragraph 5; §8, paragraph 1; and; §10 or §13 have been violated or have been violated, the organizer can expel you from the festival site and issue a house ban. If a visitor commits a crime at Streetz Open Air (e.g. drug dealing, physical harm, theft, sexual assault, etc.), the visitor will be expelled from the festival site immediately and without warning and the facts of the case will be reported to the police.

4. Expulsion and residence ban
If there is a breach of the General Terms and Conditions of Streetzrock eV or an important reason mentioned above and the organizer expels the visitor from the event site, the ticket or festival wristband loses its validity and the entrance fee will not be reimbursed. Anyone who culpably violates these terms and conditions is liable to compensate the organizer for the resulting damage.

§9 Right to your own picture
For advertising purposes, the organizer and third parties commissioned by the organizer will take photos and videos of this event. These are used exclusively for future Streetz Open Air events. According to §23 KunstUrhG, the publication of image and video recordings of meetings is permitted without consent. In principle, no portraits or individual shots are published, unless posing directly and deliberately for individual shots, as is usual when visiting concerts and discos. You are deemed to have given your consent within the meaning of §22 KunstUrhG.

§10 Prohibited and Prohibited Items
The following are prohibited on the entire event site:

1. Animals , such as elephants, rhinos, bats and all others pets . Really animals of all kinds and breeds.
2. Weapons or other items (WaffG Annex 2 to Section 2, Paragraphs 2 to 4), or which may be used as dangerous items.
3. pyrotechnic articles.
4. Generators (no power generators, see §17 point 9.).
5. open fire.
6. Compressed and liquid gases.
7. Bulky waste (old sofas, armchairs, building materials, wood, etc.). At the same time, photos of the camp are taken by us. If objects are left behind, a complaint will be made so that the disposal costs can be recovered.
8. Torches.
9. Belts with raised or pointed rivets or rivets longer than 1.5 cm and bandoleers.
10. CS gas.
11. flammable liquids.
12. Dry Ice.
13. Noisy objects.
14. Political items of any kind, including banners, signs, symbols or leaflets.
15. Drones used without the permission of the organizer.

The following are also prohibited on the entire festival site (infield):
1. drinks and food brought along.
2. Backpacks that have not been checked or large bags.
3. Any form of glass container.
4. Cans (also hairspray, deodorant etc.).
5. Flagpoles.
6. E-scooters or similar means of transport.
In addition, Streetzrock eV
reserves the right to add to the list of prohibited items to ensure public order and safety and, in case of doubt, to ban items that are not listed after on-site inspection.

§11 Cancellation or abandonment of an event; program changes
The event mentioned is an open-air event. This also takes place in bad weather, unless this makes it impossible to carry out the event safely (danger to life, limb or health for visitors, artists or staff). In this case, the event will be canceled immediately or temporarily interrupted. In this case, as well as if the festival is canceled for other reasons of force majeure, due to official orders or court decisions, there is no right to reimbursement or compensation, unless the organizer can be accused of intent or gross negligence.

§12 Health impairments due to noise and injuries
1. The visitor is aware that at Streetz Open Air, especially in front of the stages, there is a high volume and there is a risk of possible damage to health, especially hearing damage. The venue is open air, however ear plugs are strongly recommended regardless. It is advisable to choose a place to stay, near the loudspeakers or on the stage, which is conducive to individual listening habits.
2. Please note that children's hearing is even more sensitive than that of adults. If you visit our event with children, please bring suitable hearing protection for children.
3. If a medical service is required for reasons of injury and the like, the person who caused the injury bears the costs of treating the wound and also any transport costs.

§13 Protection of minors
Children and young people under the age of 18 only have access when accompanied by a person with custody or a legal guardian, in accordance with the General Terms and Conditions §1 Paragraph 1 Clause 4.

§14 Limitation of Liability
The organizer is liable within the framework of the statutory provisions without Limitation of damage resulting from even negligent injury to the body and health of the customer without the involvement of third parties. The same applies to the breach of essential contractual obligations. For other damages, liability for simple negligence on the part of the organizer and his legal representatives and vicarious agents is excluded. Liability for gross negligence and intent remains unaffected.
Basically, entering, using and staying on the entire event site is at risk.

§15 data protection
Streetzrock eV processes the customer's personal data in compliance with the applicable data protection regulations. The personal customer data (name, address, email, telephone number, etc.) are only used for the establishment and processing of the contractual relationship as well as for internal, empirical surveys and further transmission of offers and information to the customer, to the event Streetz Open Air or related Subjects. If third parties are commissioned to carry out this contract, Streetzrock eV is entitled to pass on the necessary data.

§16 Applicable Law; Miscellaneous
1. The organizer reserves the right to change the terms and conditions at any time.
2. The law of the Federal Republic of Germany applies. If the customer does not have a general place of jurisdiction in Germany or if his domicile or habitual abode is not known at the time the action is filed, the exclusive place of jurisdiction for all disputes arising from the concluded contracts with Streetzrock eV is the District Court of Dannenberg.
3. Should individual provisions of this contract be ineffective or unenforceable, or become ineffective or unenforceable after the conclusion of the contract, the validity of the rest of the contract remains unaffected. The invalid or unenforceable provision shall be replaced by a valid and enforceable provision whose effects come closest to the economic objective pursued by the contracting parties with the invalid or unenforceable provision. The above provisions apply accordingly in the event that the contract proves to be incomplete.

§17 Camping or accommodation
1.) CAMPING
There are enough campsites available. If the weather is good, you can park your car right next to your tent. Camping is free for festival ticket holders. Camping without visiting the festival is not possible with a day ticket.
If you feel massively disturbed or threatened by other visitors, contact the security or one of our club members (St.OAker)!
Please make sure not to bring any prohibited items with you.
The campsite is part of the event site. When leaving, §8 paragraph 4 and § 17 paragraph 4 apply accordingly.

Camping and driving on the campsite is at your own risk!

2.) GARBAGE
We urge you to keep your campsite clean and leave it clean. There is a rubbish container on the premises, which is to be used for the household rubbish that accumulates.
The Streetzrock eV team will ensure that our rules are observed and will also take photos of particularly “tough cases”. So if you bring furniture with you and leave it behind, you will unfortunately have to expect an additional payment for garbage deposits and a complaint.
We appeal to you to use the rubbish bins provided and NOT to throw your rubbish in the botany. You help us and nature to avoid unnecessary trouble. We thank you in advance for that!

3.) PARKING
Weekend ticket holders can park directly on the campsite. Parking there is included in the ticket price. Day guests park for a fee in our day car park. Camping in these parking lots is not permitted. Of course, no one will get upset if you sleep in your car because you've had one too many.

4.) TOILETS
A sufficient number of portable toilets are available throughout the festival site. These are cleaned daily and use is free of charge. Handycap toilet is available for you in a separate area.

6.) FUEL IN SPARE CANS
You are allowed to take one spare fuel canister per vehicle to the Streetz Open Air, it must not hold more than 20 liters of petrol or diesel and must comply with DIN standard 7274 or 16904. This means that it must be tight, lockable and unbreakable.

5.) GAS BOTTLES
Compressed gas or liquid gas bottles that are operated with an additional pressure reducer are not permitted on our camping site. This applies to all gases, including carbon dioxide, oxygen, helium, etc., and to the operation of beverage dispensing systems.
Only permanently installed butane gas bottles in caravans/mobile homes with the appropriate fuse, valid gas test certificate and current general inspection are permitted.

7.) FIRE AND BBQ
Open fire is prohibited on the entire festival site!
Commercial gas camping stoves with gas cartridges, camping stoves with solid fuel (so-called ESBIT stoves) and charcoal grills are permitted, provided they are used exclusively for preparing food. Normal handling, i.e. no injuries due to improper handling, is assumed.
Alcohol is not a grill lighter! We recommend the use of non-liquid fire starters or so-called fire starters.
Alcohol, lamp oil, kerosene lamps, braziers, firewood and torches are prohibited!
Should it be extremely dry, we reserve the right to prohibit barbecuing.

8.) Access
The divided tramlines are to be kept free. These serve as escape and rescue routes. Lines or mooring lines for tents may also not be installed in this area.

9.) Power Generator
The operation of power generators is only permitted in connection with a fireproof base under the device. Unless the device is integrated in a plastic housing.

10.) Sewage/waste water
It is forbidden to empty faecal tanks on the event site. Other dirty water may also not be disposed of on the event site.

11.) Drinking water
There are no drinking water points on the entire event site. The water is only service water, suitable for washing.

§18 St.OA on tour on November 19th, 2022
1.) The terms and conditions § 1 up to and including § 16 apply equally to the event "St.OA on Tour" and are applied. Changes and additions to these paragraphs are listed in §18.
2.) When buying the ticket for St.OA, on tour, everything refers to November 19, 2022 from the start of the event to the end of the event
3.) Instead of the festival site in Streetz, all entry conditions and hazard warnings refer to the event hall of the Willi Schulz inn, Heider Chaussee 12, 29451 Dannenberg.
4.) Damage to property in the hall caused by the event visitor will be reported and invoiced.
5.) Admission also with legal guardians or legal guardians only from the age of 16.
6.) Admission to St.OA on Tour will be closed with the last band.
7.) If the entrance is closed, access is only permitted with the entry wristband.
